EDP Renewables affiliates secure three new power project sites

Several project affiliates of EDP Renewables North America LLC filed an April 27 report with the Federal Energy Regulatory Commission showing that in the first quarter of this year, related companies secured three sites in New York and the Southwestern U.S. for new projects.

Those reporting companies include Arbuckle Mountain Wind Farm LLC, Blue Canyon Windpower LLC, Blue Canyon Windpower II LLC, Blue Canyon Windpower V LLC, Blue Canyon Windpower VI LLC, Cloud County Wind Farm LLC and Waverly Wind Farm LLC.

The report complies with a FERC rule, based on market power concentration issues, that says certain power companies need to report on a quarterly basis when they obtain new project sites. The sites in question are in the Southwest Power Pool (SWPP) balancing authority area (BAA) and the New York Independent System Operator (NYISO) BAA.

  • During the first quarter of this year, an affiliate demonstrated site control in the interconnection process (or paid deposits in lieu of site control) for one site for wind development located in the SWPP BAA. The maximum potential that is reasonably commercially feasible on this unspecified site is approximately 200 MW.
  • Also in the first quarter, one or more affiliates demonstrated site control in the interconnection process (or paid deposits in lieu of site control) for two sites for wind development located in the NYISO BAA. Again, site specifics aren’t mentioned. The aggregate maximum potential number of megawatts that are reasonably commercially feasible on these sites is approximately 280 MW.

“Sellers’ affiliation with these additional sites for new generation capacity development does not raise any competitive concerns,” the report noted. “The Commission has adopted a rebuttable presumption that ownership or control of such sites does not allow an entity selling electricity at market-based rates to erect barriers to entry. Further, Sellers affirm that Sellers and their affiliates have not erected barriers to entry in the relevant markets and will not erect barriers to entry in the relevant markets.”
